A demand letter is typically the first step before filing a small claims lawsuit. Many states strongly recommend or even require sending one before filing. How to Send Your Demand Letter

Send your demand letter via certified mail with return receipt requested. This provides proof that the recipient received the letter, which is critical evidence in court. The green return receipt card (or electronic tracking confirmation) shows the date the letter was delivered and who signed for it. Keep this receipt with your copy of the letter.

You may also send a copy via email with a read receipt, but certified mail is the gold standard because it is virtually impossible to dispute. Some people send the letter by both certified mail and email for maximum documentation.
